Noir Hair
Article 1 – Definitions
- Seller: Noir Hair, located at Lenningenhof 51, 5625NS Eindhoven, Netherlands, registered with the Chamber of Commerce under number 93989806. In these terms and conditions, Noir Hair is referred to as “Noir Hair” or “the seller.”
- Customer: Any natural or legal person who enters into an agreement with Noir Hair. The customer can be a consumer (B2C) or a business customer (B2B).
- B2C (Business to Consumer): A transaction between Noir Hair and an individual consumer purchasing products for personal use, not for commercial purposes.
- B2B (Business to Business): A transaction between Noir Hair and a business customer, such as a salon or company, purchasing products for commercial purposes or resale.
- Agreement: The purchase agreement between the customer and Noir Hair regarding the purchase of products.
Article 2 – Applicability
- These terms and conditions apply to all offers, quotations, orders, and agreements between Noir Hair and the customer.
- By placing an order with Noir Hair, the customer agrees to the contents of these terms and conditions.
- Deviations from these terms are only binding if confirmed in writing by Noir Hair.
Article 3 – Product information and color guarantee
- Product photos on the Noir Hair website are for indicative purposes only; no rights can be derived from them. The customer acknowledges that hair extensions are a natural product, and products may sometimes vary.
- Noir Hair strives for color and texture accuracy within an acceptable range. Differences in color or texture may arise due to natural factors or screen settings and are not grounds for complaint.
- Color variations due to screen settings are not grounds for compensation or exchange. Noir Hair is not liable for such variations.
- Noir Hair reserves the right at all times to modify packaging, packaging contents, models, and colors.
Article 4 – Offers and prices
- Noir Hair offers a range of hair extensions in various techniques, wigs, personalized custom options, and educational training.
- Product and service prices on the website are listed in euros, excluding 21% VAT and shipping costs for business customers (B2B) and including 21% VAT, excluding shipping costs for consumers (B2C).
- If shipping costs apply, these will be clearly indicated before concluding the agreement and will be shown separately during the order process.
- For orders with a delivery address outside the Netherlands, shipping rates of Noir Hair’s selected carrier will apply. These rates are clearly stated on the website.
- The content of the website is composed with the utmost care. However, Noir Hair cannot guarantee that all information is complete and accurate. All prices and information on the Noir Hair website are subject to possible programming and typographical errors. Noir Hair reserves the right to change prices at any time.
Article 5 – Payments
- Noir Hair offers various payment options, including: iDEAL, Credit Card, Bancontact, PayPal, Klarna, Apple Pay, Google Pay, Sofort Banking, and Giropay.
- All orders must be fully paid in advance unless otherwise agreed upon in writing.
- For custom and bulk orders, Noir Hair can only process the order after receiving full payment.
- If Noir Hair has agreed to deferred payment in writing with business customers, the invoice must be paid within 14 calendar days of the invoice date.
- If the customer does not fulfill their payment obligations on time, Noir Hair reserves the right to charge statutory interest on the overdue amount and collect external collection fees if payment is not received within the specified period.
- All delivered products remain the property of Noir Hair until full payment has been received from the customer.
Article 6 – Delivery and shipping
- Products in stock are delivered within 1-3 business days after the order is placed. Delivery times outside the Netherlands may vary from 3-5 business days.
- Bulk and custom orders have a delivery time of 3-6 weeks, depending on the specifications and complexity of the order.
- Starter kits for B2B customers have a delivery time of 3-6 weeks, as they are customized to specific needs.
- Delivery times are indicative. Noir Hair is not liable for costs or damages resulting from exceeding the specified delivery time.
- Noir Hair is not responsible for delays caused by the carrier and does not provide compensation for such delays.
- Loss, breakage, theft, or other damages during transport will be compensated by Noir Hair if the shipment includes insurance and evidence of damage is provided.
- Noir Hair offers free shipping within the Netherlands and Belgium.
Article 7 – Return policy and right of withdrawal
- Products can be exchanged within 14 days, provided the packaging seal is unbroken, undamaged, or resealed. The customer acknowledges that hair products fall under the category of cosmetics and, for hygiene reasons, cannot be returned or exchanged if the packaging is opened, damaged, or altered.
- Noir Hair will only issue a refund if the conditions in Article 7.1 are met.
- If the products are not satisfactory, the customer must report this within 7 days of delivery via email (returns@noirhair.nl), including name, order number, and reasons for the complaint. Noir Hair will replace or refund the item at its discretion if the complaint is justified.
- Customized products, such as starter kits, custom, and bulk orders, are specifically made to order and cannot be returned or exchanged unless there is a manufacturing defect.
- No changes can be made to customized products after confirmation.
- Return shipping costs are the customer’s responsibility unless the product is defective upon delivery, in which case proof of defect must be provided.
- Returns without registered mail are at the customer’s own risk. If the customer opts not to send the return by registered mail, Noir Hair is not responsible for loss of the shipment and will not issue a refund.
- Return forms are available on the Noir Hair website and are included with every order. The return form must be included with the returned product.
- A return is refunded only after it has been received and approved by Noir Hair in compliance with the terms and conditions.
Article 8 – Warranty
- Noir Hair offers a 30-day warranty, provided the products are used following the care instructions. Damage from chemical treatments, such as coloring or silver shampoo, perming, or keratin treatments, is not covered under warranty.
- Quality complaints must be submitted within thirty (30) calendar days of purchase in writing with a clear explanation. No claim can be made if a defect is not reported within this period.
- Trimming or resizing the keratin flat tips is at the customer’s risk.
- Chemically treated products or products that have undergone color changes are not eligible for warranty.
- Noir Hair does not provide a warranty for incorrect color or texture choices by the customer.
- We recommend professional installation for our products; the warranty is void if not installed by a certified professional.
- Noir Hair is not liable for work performed by third parties.
- Noir Hair does not provide a warranty for attachment methods that the wearer finds uncomfortable.
- In the case of a quality issue, a replacement product of equal nature and value will be offered; refunds or compensation for third-party costs are not provided. If the product is unavailable, a credit note for the purchase amount will be issued for use on the Noir Hair website.
- Noir Hair will respond to complaints within 7 days of receiving them. If a definitive solution is not possible immediately, Noir Hair will acknowledge receipt and indicate when a final response can be expected.
Article 9 – Liability
- Noir Hair is not liable for damages caused by improper use or of the delivered products.
- Color or texture differences may occur due to the natural nature of the hair or screen settings. Noir Hair is not liable for such variations.
- Noir Hair is not liable for indirect damages, including but not limited to consequential damages, lost profits, lost savings, data loss, or business interruption damages.
- In the event of force majeure, Noir Hair is not obliged to compensate for damages caused to the customer. Force majeure includes natural disasters, pandemics, wars, strikes, government measures, transportation issues, fire, and major operational disruptions. If the force majeure lasts longer than thirty (30) days, both Noir Hair and the customer can dissolve the agreement in writing without the right to compensation.
- The use of hair extensions and/or related products supplied by Noir Hair is entirely at the customer’s own risk.
- Noir Hair is not liable for work performed by third parties using Noir Hair products.
- Noir Hair explicitly states it is not responsible or liable for any physical or psychological damages resulting from the use of hair extensions or wigs.
Article 10 – Complaints
- Complaints about products or services can be submitted in writing via support@noirhair.nl, with a clear description and supporting images if applicable.
- Noir Hair aims to resolve complaints within 14 days in good consultation.
Article 11 – Disputes and applicable law
- All agreements between Noir Hair and the customer are governed by Dutch law.
- Disputes will be submitted to the competent court in ’s-Hertogenbosch, unless mandatory law dictates otherwise.
Article 12 – Changes to the terms and conditions
- Noir Hair reserves the right to change these terms and conditions at any time. The most recent version is always available on the website.
- By placing an order after a change in the terms, the customer agrees to the new terms.
